Terms & Conditions of Accession
Governing Atelier Accessions, Fine Art Acquisition, and Bespoke Gemstone Commissions under the laws of India.
Effective Date: September 14, 2026 | Governing Jurisdiction: Udaipur, Rajasthan, India1. Scope & Legal Framework
These Terms & Conditions ("Terms") govern your use of the website https://dev.crystalart.gallery/, private salon appointments, acquisition of mineral artwork, and bespoke lapidary commissions provided by Crystal Art Gallery ("Atelier"), situated in Udaipur, Rajasthan, India.
By accessing our website or entering into an accession contract, you agree to be bound by these Terms in accordance with the Indian Contract Act, 1872, the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, and the Information Technology Act, 2000.
2. Intellectual Property Rights
All content, lapidary artwork designs, relief sculpture concepts, high-resolution photography, 3D render visualizations, trademarks, and curatorial literature displayed on this website are the sole intellectual property of Crystal Art Gallery and are protected under the Copyright Act, 1957 and Trade Marks Act, 1999 of India.
No portion of our artwork designs, photographs, or proprietary light matrix configurations may be reproduced, copied, modified, or commercially exploited without express written consent from the Atelier.
3. Natural Mineral Authenticity & Unique Characteristics
Every creation within our collections—including Lava Art, Glowing Crystal, Crystal Illuminate, Relief Sculpture, and Inspiration from Nature—is handcrafted from authentic, earth-mined geological specimens (e.g., amethyst geodes, optical calcites, quartz obelisks, volcanic basalt).
- Geological Inclusions: Natural mineral variations, internal striations, color zoning, and crystal growth cleavage are inherent hallmarks of authentic geological masterpieces and do not constitute defects.
- Authenticity Certification: Every accession is accompanied by a formal Certificate of Authenticity specifying mineral specimen origin, Mohs hardness rating, and curatorial serial number.
4. Quotations, Pricing & Applicable Taxes
All artwork prices and advisory estimates are provided in Indian Rupees (INR ₹) or United States Dollars (USD $) as agreed during private consultation.
- Statutory Taxes (GST): Invoices issued within India include applicable statutory Goods and Services Tax (GST) under Indian tax regulations.
- International Accessions: For international collectors, export documentation and custom clearances are prepared under Indian Customs regulations. Import duties or local taxes in the destination country remain the responsibility of the collector.
- Validity: Private proforma invoices and curatorial estimates are valid for 30 calendar days from issuance.
5. Armored Delivery & Transit Insurance
In accordance with the Consumer Protection (E-Commerce) Rules, 2020, we take full responsibility for ensuring artwork is securely packed in custom climate-controlled wooden crates and transported via accredited armored logistics partners (e.g., Sequel Logistics, Blue Dart, DHL Express).
All transit is 100% insured against loss or transit damage until physical hand-off and signature receipt at your specified residence, yacht, or penthouse gallery destination.
6. Bespoke Commissions & Cancellation Policy
Because our gemstone sculptures and illuminated architectural installations are individual, non-fungible artworks tailored to client spatial specifications:
- Bespoke Commissions: Once a custom commission contract is executed and lapidary cutting commences, commission deposits are non-refundable.
- Inspection & Transit Verification: Collectors or authorized representatives must inspect the crate upon delivery. In the rare event of transit damage, notification must be submitted to the Atelier within 48 hours with photographic verification for insurance claim processing and restoration.
7. Limitation of Liability
Crystal Art Gallery shall not be liable for any indirect, incidental, or consequential damages resulting from improper physical installation, drop impacts after delivery, or exposure of natural mineral stones to extreme chemical corrosives.
In all circumstances, our maximum financial liability under any accession contract shall be capped at the total amount paid by the collector for the specific artwork.
8. Dispute Resolution & Arbitration
Any dispute, controversy, or claim arising out of or relating to these Terms or an accession contract shall be settled amicably through private curatorial mediation. If unresolved, disputes shall be referred to sole arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India.
The seat and venue of arbitration shall be Udaipur, Rajasthan, India, and proceedings shall be conducted in the English language.
